Terms of Service

These Terms of Service (hereinafter referred to as "these Terms") set forth the conditions for using the services (hereinafter referred to as "the Service") provided by Natsuneko Laboratory (hereinafter referred to as "the Operator") on this website. All registered users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.

Note: This is an English translation of the original Japanese Terms of Service. In the event of any discrepancy between the English and Japanese versions, the Japanese version shall prevail.

Article 1 (Application)

  • These Terms shall apply to all relationships between Users and the Operator regarding the use of the Service.
  • In addition to these Terms, the Operator may establish various rules and regulations regarding the use of the Service (hereinafter referred to as "Individual Provisions"). Regardless of their titles, these Individual Provisions shall constitute part of these Terms.
  • If any provision of these Terms contradicts any provision of the Individual Provisions mentioned in the preceding paragraph, the provisions of the Individual Provisions shall prevail unless otherwise specified in the Individual Provisions.

Article 2 (User Registration)

  • For the Service, user registration shall be completed when a prospective registrant agrees to these Terms, applies for user registration by the method prescribed by the Operator, and the Operator notifies the prospective registrant of approval of such registration.
  • The Operator may not approve an application for user registration if the applicant falls under any of the following circumstances, and the Operator shall have no obligation to disclose the reasons for such non-approval:
    • When false information is provided in the application for user registration
    • When the application is from a person who has violated these Terms
    • When the Operator otherwise deems the user registration inappropriate

Article 3 (Management of User ID and Password)

  • Users shall properly manage their User ID, password, and passkey for the Service at their own responsibility.
  • Users may not, under any circumstances, transfer, lend, or share their User ID and password with third parties. The Operator shall deem any login made with a combination of User ID and password, or with a passkey, that matches the registered information as use by the User who registered such User ID.
  • The Operator shall not be liable for any damages arising from the use of User ID and password, or passkey, by third parties, except in cases where the Operator has acted with intent or gross negligence.

Article 4 (Usage Fees and Payment Methods)

  • Users shall pay the usage fees for the paid portions of the Service, as separately determined by the Operator and displayed on this website, by the method designated by the Operator.

Article 5 (Prohibited Actions)

Users shall not engage in any of the following actions when using the Service:

  • Actions that violate laws and regulations or public order and morals
  • Actions related to criminal activities
  • Actions that destroy or interfere with the functions of servers or networks of the Operator, other Users of the Service, or third parties
  • Actions that may interfere with the operation of the Operator's services
  • Actions to collect or accumulate personal information about other Users
  • Actions of unauthorized access or attempts thereof
  • Actions of impersonating other Users
  • Actions of providing benefits, directly or indirectly, to antisocial forces in relation to the Operator's services
  • Actions that infringe upon the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the Operator, other Users of the Service, or third parties
  • Actions of posting or transmitting content on the Service that contains, or that the Operator deems to contain, any of the following expressions:
    • Excessively violent expressions
    • Explicit sexual expressions
    • Expressions that lead to discrimination based on race, nationality, creed, gender, social status, family origin, etc.
    • Expressions that induce or encourage suicide, self-harm, or drug abuse
    • Other expressions that contain antisocial content and cause discomfort to others
  • Actions for, or deemed by the Operator to be for, any of the following purposes:
    • Business, advertising, publicity, solicitation, or other profit-making purposes (except those approved by the Operator)
    • Sexual acts or obscene purposes
    • Purposes of meeting or dating unfamiliar persons of the opposite sex
    • Purposes of harassing or defaming other Users
    • Purposes of causing disadvantage, damage, or discomfort to the Operator, other Users of the Service, or third parties
    • Other purposes of using the Service for purposes different from those intended by the Service
  • Religious activities or solicitation to religious organizations
  • Other actions that the Operator deems inappropriate

Article 6 (Suspension of Service Provision)

  • The Operator may suspend or interrupt all or part of the Service without prior notice to Users if any of the following circumstances occurs:
    • When performing maintenance, inspection, or updates of computer systems related to the Service
    • When it becomes difficult to provide the Service due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
    • When computers or communication lines stop due to accidents
    • When the Operator otherwise determines that it is difficult to provide the Service
  • The Operator shall not be liable for any disadvantage or damage suffered by Users or third parties due to the suspension or interruption of the Service provision.

Article 7 (Copyright)

  • Users may use the Service and post or upload only information such as text, images, and videos for which they hold the necessary intellectual property rights, including copyrights, or have obtained the necessary permission from the rights holders.
  • Copyrights for text, images, videos, etc. posted or uploaded by Users through the Service shall remain with such Users or other existing rights holders. However, the Operator may use text, images, videos, etc. posted or uploaded through the Service to the extent necessary for improving the Service, enhancing quality, correcting deficiencies, and promoting the Service, and Users shall not exercise their moral rights of authors regarding such use.
  • Except as provided in the main clause of the preceding paragraph, all copyrights and other intellectual property rights related to the Service and all information related to the Service belong to the Operator or rights holders who have licensed their use to the Operator, and Users shall not reproduce, transfer, lend, translate, modify, reprint, publicly transmit (including making transmittable), transmit, distribute, publish, or use for commercial purposes without authorization.

Article 8 (Usage Restrictions and Registration Deletion)

  • The Operator may, without prior notice, delete posted data, restrict all or part of the Service use by Users, or delete User registration if the User falls under any of the following circumstances:
    • When violating any provision of these Terms
    • When it is discovered that there are false facts in the registered information
    • When there is no response to communications from the Operator for a certain period
    • When the Operator otherwise determines that the use of the Service is inappropriate
  • If a User falls under any of the items in the preceding paragraph, the User shall naturally lose the benefit of time for all debts owed to the Operator and must immediately repay all debts owed at that time in a lump sum.
  • The Operator shall not be liable for any damages caused to Users by actions taken by the Operator based on this Article.

Article 9 (Withdrawal)

Users may withdraw from the Service by following the withdrawal procedures prescribed by the Operator.

Article 10 (Disclaimer and Exemption from Liability)

  • The Operator does not expressly or implicitly guarantee that the Service is free from factual or legal defects (including defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, infringement of rights, etc.).
  • The Operator shall not be liable for any damages caused to Users arising from the Service, except in cases of intent or gross negligence by the Operator. However, this exemption provision shall not apply if the contract between the Operator and the User regarding the Service (including these Terms) constitutes a consumer contract as defined in the Consumer Contract Act.
  • Even in cases specified in the proviso of the preceding paragraph, the Operator shall not be liable for any damages arising from special circumstances (including cases where the Operator or the User foresaw or could have foreseen the occurrence of damage) among damages caused to Users due to breach of contract or tort by the Operator's negligence (excluding gross negligence). In addition, compensation for damages caused to Users due to breach of contract or tort by the Operator's negligence (excluding gross negligence) shall be limited to the amount of usage fees received from the User in the month in which such damage occurred.
  • The Operator shall not be liable for any transactions, communications, or disputes that occur between Users and other Users or third parties in relation to the Service.

Article 11 (Changes to Service Content)

The Operator may change, add, or discontinue the content of the Service with prior notice to Users, and Users agree to such changes.

Article 12 (Changes to Terms of Service)

  • The Operator may change these Terms without obtaining individual consent from Users in the following cases:
    • When the changes to these Terms conform to the general interests of Users.
    • When the changes to these Terms do not contradict the purpose of the Service usage contract and are reasonable in light of the necessity of the changes, the appropriateness of the content after the changes, and other circumstances related to the changes.
  • The Operator shall notify Users in advance of the changes to these Terms pursuant to the preceding paragraph, including the fact that these Terms will be changed, the content of the changed Terms, and the effective date thereof.

Article 13 (Handling of Personal Information)

The Operator shall appropriately handle personal information acquired through the use of the Service in accordance with the "Privacy Policy."

Article 14 (Notices or Communications)

Notices or communications between Users and the Operator shall be made by the method prescribed by the Operator. Unless the Operator receives a change notification from the User in accordance with the format separately prescribed by the Operator, the Operator shall deem the currently registered contact information as valid and send notices or communications to such contact information, which shall be deemed to have reached the User at the time of transmission.

Article 15 (Prohibition of Transfer of Rights and Obligations)

Users may not transfer their position under the usage contract or any rights or obligations under these Terms to third parties, or pledge them as collateral, without the prior written consent of the Operator.

Article 16 (Governing Law and Jurisdiction)

  • These Terms shall be governed by and construed in accordance with the laws of Japan.
  • In the event of any dispute arising in connection with the Service, the Yokohama District Court shall have exclusive jurisdiction.
